some of you who answer this question are suppose to assist not be judgemental........I am just looking for answers, some say i need an attorney some say I don't. I just want to make sure that I am doing it correctly.

Yes you need an attorney, one wrongly written line could make the document void

It's not about being judgemental, it's about being practical.

I've overhauled engines before. I'd tackle one today, as I know how to do it. I've never overhauled an automatic transmission, though, so I'd hire an expert to at least guide me the first time.

I can build a Windows Server in my sleep. But if I had to build a Linux Server, I'd hire a Linux guru to help me get it up and running.

And if the court clerk told me I needed an attorney to properly draw up a quitclaim deed, I'd take his or her advice and hire the attorney. It's not like it would cost a fortune -- a real estate attorney can do THAT in her sleep. And I'd know that it was done right!

If your question is, is it LEGAL to do by yourself, yes it is. If the question is, is it a good idea unless you are absolutely sure that you know how to do it correctly, then no it isn't. You could, for example, end up responsible for a loan on the property but not have title to it any more.

A lot of people make the same mistake you did and call it quickclaim even though it's really quitclaim, so that's not a big deal.

Ok first of all I know where you are coming from when you ask for people not to be judgmental, I do not like that either. Second of all, I work for an attorneys office, you do not need an attorney to fix this problem, I am almost positive that all you have to do is go where you recorded your document and ask them if you can record what is called an "AFFIDAVIT OF SCRIVENORS ERROR". Just to double check this for you I will ask my boss in the morning and def get back to you on it. But I am almost positive that I am correct.

First, this question should be in LAW not TAXES. You only need a lawyer if you are not sure how to do it correctly yourself. The fact you have asked this question twice today tells me you don't know how to do it correctly yourself.

When I filed a quickclaim deed, I went to the Property Records department, told them what I wanted to do and they gave me the proper forms. I filled them out and had the person I was filing the quickclaim for give me a dollar and that was that. They had the property for a Dollar and it was then theirs.

In answer to your question, per my own function, an attorney is not required or necessary. It is quite an easy function to perform.
