Can anyone help, i swerved to miss a car and I hit a tarmac wagon. This wagon was in a dim light road and well not in a good position, I had right of way but i had to swerve to miss it, but the car sped off. Mty car looks like it is a write off, and im devasted it;s my 1st car, my problem is i only have third party fire and theft, can i make any claim. Thanks

This lorry is parked uo near where i live every night and it is parked uner a light but the light was not working. i do have legal cover why what does that entail. thanks again

Unfortunately unless you managed to get the Reg Number then you will have no one to claim against, however the tarmac van you damaged will be able to claim for there cost of repair. You might have some luck if you can get any CCtv footage but you will need to report it ASAP to the police otherwise you could be prosecuted for leaving the scene of an accident. Sorry its not good news

You may have a claim against the owner of the tarmac wagon.
The Highway code states:-
Cars,goods vehicles not exceeding 1525kg unladen,invalid carriages and motorcycles may be parked without lights on a road (or a lay-by) with a speed limit of 30mph or less if they are
1. at least 10 metres (32ft) away from any junction, close to the kerb and facing in the direction of the traffic flow.
2. in a recognised parking place or lay-by
OTHER VEHICLES AND TRAILERS,AND ALL VEHICLES WITH PROJECTING LOADS, MUST NOT BE LEFT ON A ROAD AT NIGHT WITHOUT LIGHTS.
Is the wagon a trailer, does it have projections, is it over the weight limit, did it have lights, was it facing the right way, was it near a junction.
Report ALL the details to you insurers and leave them sort it out. If the Tarmac wagon shouldn't have been parked there you MAY have a valid claim.
Make sure you report it to the police as soon as possible, otherwise you may get booked for leaving the scene of an accident.

Well did you make a police report and give a description of the car that caused you to swerve and then sped off? If you don't have collision you can't make a claim but if you find out who the person was that caused the accident you may be able to get their insurance to pay (though they most likely had none) or take them to court for the value of your car. I suggest the next car you get..if it's not 10 years old or older.. you get collision and comprehensive insurance then your car can be fixed by them.

I hate to say it Helene, that unless you make up some elaborate and believable lie how you're not to blame, then its not very likely you will be compensated for this. Third party is the bare minimum insurance you can have and it generally does what it says on the tin, i.e. it pays for the other person to get their vehicle fixed. Not only this, but if and when you get another car, your premiums will shoot up as a result of this claim. I'm sorry for your situation. Hopefully, as Philhny above me there pointed out, your insurance company will find a legal loophole. I'll keep my fingers crossed.

Here in the U.S., you, the driver, have a responsibility to NOT drive into a stationary object -- like a tarmac wagon. Sorry to say but the chances of insurance covering your vehicle are practically zero. Your insurance WILL cover damage to the wagon.

There is no-one to claim off,your insurance will only pay for damage to the tarmac wagon. So sorry.

Under your current insurance coverage you can not file a claim. This is why it costs more to insure when you include other kinds of coverage.

The only coverage you get, like you said.. is Theft, and Fire. Unless your car burned down as a result.. you're stuck

i'm really sorry to hear that - I know how much it shakes you up as I've been in a couple myself! Unfortunately, if you haven't got the other car's number plate you have very little chance of making a claim, and from personal experience the police are extremely slack at following things like this up if no one has been seriously injured. Inform your insurance company and the police, but I don't think you've got much hope. The way I see it, its tough and expensive, but you could have lost your life so just be glad that you weren't seriously injured. Cars can be replaced, you can't.

Sorry but if you hit a stationary object in your moving car, it's down to you. Get comprehensive next time. It happened me too and I got over it. I just had to drive a really rubbish car for a year until I saved enough to buy a decent one. (rubbish = VW Jetta diesel, with no turbo)

Wait- who on earth or how on earth do you think you will get the money for repairs?

You are clearly at fault here. You cant cause one accident to avoid another.

You have third party insurance.. your at fault... you dont get paid.

What else is there to discuss?
