Can my mother, who is single, file head of household because my brother (who is 26) lives with her and didn't have any income for all of 2006? He has lived with her for two years, but because he has been trying to get into the military and didn't work anywhere last year she supported him. Would he qualify her for head of household?

Thanks for the advice on the military, but he just left on January 3rd. He is in the army now and he was only trying for the past year, not 2 years. He had a few things to clear up before he could join. But he has helped my mom out a lot by staying with her and now he is in boot camp. We are very proud of him.

your mother can claim "head of household" since she maintained a home and also provided all of your brothers support. since he did not earn any income, she can claim him as a dependent.

She can probably claim him as a qualifying relative and file as head of household. He would have had to make less than $3300 for the year (sounds like he didn't) and she would have had to pay more than half of his support for the year.

Side note: If he's been trying to get into the military for two years and hasn't succeeded yet, maybe it's time for him to find a job in the meantime. I realize you didn't ask this, and that it isn't any of my business.

Yes, your mom can still file head of household. Your brother can still be considered a dependent even though he is over 24 since he lived with her for the entire year and did not earn more than $3,300.

Actually, she might be able to claim him as a dependent and file as HoH. If his gross income is less than $3,300 and she provided more than half of his support, she can claim him as a dependent. If she paid more than half the cost of keeping up a home for the year, she can file as HoH since she can claim him as a dependent.

No - to qualify for head of household - or to even claim your lazy brother - he needs to be 18 or under, or 23 and under and a full time student.

Tell your brother to quit taking from your mom - she raised him - he should be able to stand on his own two feet.
