If your number is on a national (or international) "Do Not Call" registry, then they can be charged with a crime. In some instances, the fine can be as high as $10000 US PER CALL ... whether you actually answer the call or not.
If you aren't registered as a "Do Not Call", you're out of luck. They can call anytime ... and usually do.
Note that some registries require that you renew your status (i.e. I STILL don't want them to call!) every so often ... and that it takes a while between when you 'sign up' (or renew) and when the registry takes effect, making further calls to the number a criminal act.

It is not illegal so to speak, however, it is highly frowned upon by the governing bodies of telemarketing and usually incurs a penalty.
