My boyfriend and I both own a house together, Both our names are on the mortage and we are single. I've been claiming single-head of household for the past few years, but now he's made more than me this year. Can he file single-head of household this year as long as I file myself seperately?

If you have been filing head of household and don't have a close relative (NOT a boyfriend) as a dependent, you're living on borrowed time until the IRS catches up with you and you have to pay the back taxes.

Read the instructions for head of household, or the table on page 23 of IRS Publication 17 (download at irs.gov) titled "Who is a qualifying person qualifying you to file as head of household.". Unless there is another person living with you that you didn't mention, and they meet these requirements, neither of you can file as head of household. The only exception is if you are supporting a parent and are entitled to claim them as a dependent - then you could file as head of household.

For tax purposes, you are only considered a head of household if you have a qualifying dependent. If both you and your boyfriend each has a qualifying dependent (and not the same one) then you can both be considered head of household.

Neither of you can file as HoH. Neither of you are qualifying persons for HoH status for the other. Period!

If you filed HoH in past years you can exepect to hear from the IRS eventually once they start matching up tax returns and income, etc. You weren't entitled to it then, and aren't entitled to it now.
