I had to file a form 8379 after I filed with H & R Block, cause I found out that my husband's ex wife, made false charges. I have been told that the full amount of my refund went to the child support, however, the only income we have is MINE. I am ready to get my money back, and wondered if I would have to wait the full 8 weeks that it takes to process this form? Can I expect my money sooner?

Well, the IRS keeps any refund for this matter for 6 months no matter what! Reason is that alot of times this situation causes both parties to call the IRS and dispute ect. I was told this money is held for 6 months. Once the IRS receives the 8379 they will immedeatly put a hold on the refund but this mother may have already get the check and cashed it. Doing taxes and getting a check takes alot less time than 8 weeks.

You have 2 years max to file this 8379 to not be considered responsible for your husbands past tax, support etc. obligations.

You can get updates by contacting the TREASURY DEPT.

If you filed the ISA form with a paper return it typically takes about 8 weeks to process.

If you e-filed and followed up with the ISA form but the funds had already been taken by FMS it may be months before you get anything back.

Unfortunately, 8 weeks is probably a little too hopefull.
