im pregnant from a married immigrant stil awaiting his greencard,the thing is i recently foundout that he is married for his papperwork and his wife will retract the paperwork if she findsout im pregnant,my question is if she findouts can he be deported for real?

Hi there,
If the illegal/legal/would-be non-immigrant hasn't received his green card as of today, and his wife finds out that her hubby has been sleeping with another woman and impregnated her and finally decids to divorce the illegal/legal/would-be non-immigrant, then the petition she filed to USCIS for her alien husband will be cancelled, although that doesn't simply mean that he's going to get deported.

Nowadays I believe that there are several ways an illegal alien can avoid getting deported and remember that if by any means the alien has ever provided the USCIS with accurate information regarding his true street, state and apartment address as well as phone/cell numbers, then it's easy for the immigration agents to track him down. If, unfortunately, the US citizen cancels the petition, the alien (your husband) should leave the state he is residing in right now and move to somewhere else.

I don't know anything about your status and hence would like to refrain from commenting on you. However, it's advised that you contact a certified and competent lawyer as soon as possible and also ask your boyfriend/alien not to reveal anything to the US citizen in question.

Also remember that even after the alien gets the green card, he would have to stay married to the US citizen for at least some more three years and after that he can finally get off the hook for real.

And please don't pay heed to people who are cursing, bashing and humiliating you. Listening and caring about what they have to say won't do this case of yours any good. Always try to stay 100 percent positive and think and educate yourself properly before you want to make a decision.

Hi, It will not make any sense to take the risk of telling his wife about it. Yes he could possible loose his green-card-to-be and he could also get be put in jail and then deported. Right now who knows what INS would do the laws are always changing. So tell him not to take the risk and keep it a secret until he gets his citizenship(5 years after receiving his green card).

Yes he can be deported. And once he gets his green card it will only be given to him for a period of two years, after that he has to go back to INS and if he is no longer married his green card may get revoked. He would have to initiate the process again and it might result in a very difficult situation. You might want to consider if you want to go through all of that? Yes - he can be deported and if all they are getting married for is for him to stay here - he should leave her - they'll both end up in jail when they are caught and they will get caught.

no, he won't get deported because they think he'll just come back. There are more severe consequences like jail time for example

the us doesn't deport people anymore. should he be deported, yes. He sidestepped the law to be here. If he already has a green card, it can't be retracted. If he's still waiting for it, he could be.
