He has to apply himself. He can't "just come." That's illegal.
We already have 20+ million that just chose to "just come."

OOOOhhh i know this answer as the palm of my hands.
Believe me i have just done it and i live in SD california.
Ok, here are the bad news, a year ago this was pretty easy and all the years behind, since you used to get married an apply (1000dlls aprox) and then your partner would inmediatly get is green card and SSN buttttttt the new rule is first the interview then you get the documents and not the old other way.
This is a timeline from my case:
1. get married lets say march 1, 2007 in San Diego, Ca.
2. apply for adjustment status you can do this by a notary since you cant go an apply in person, the notary will mail the paperwork to chicago so, it takes with all the proper documents (birth certificates from both, work information from you and you have to prove that you earn more than 25k year why? because since the green card will take a while you will have to maintain your partner, medical tests, work letters, information from both of you about 5 years prior to this date, etc. So, it will take depending on the notary 5 days to fill this (mine took 3)
3. Lets say the notary sends the info March 8th, 2007
4. In less than 3 weeks you should receive from INS prove of the $1000 you send them (receipts) April 1, 2007
5. Should receive an appointment for biometrics and fingerprints lets say April 20, 2007
5. You will receive a letter with a date for the interview of both of you, where you have to prove this is not an arrange marriage May 2007 (lets say the interview its for June 2007 because it cant take more than 3 months, my case took exactly 3 months 1 day from the day i sent the paperwork till the interview)
6. The interview will take 15mins.
7. If the interview was good you should receive another letter saying you have been aproved to petition for your wife. 2 weeks after the interview.
8. and then just wait aprox from 3 moths to get the work permit after the interview to 6 months to get a welcome letter to the us.
9. after the welcome card it should take another 2 weeks to get the green card
10. after you have the green card you should go to the SSA to get a social security number (IM IN THIS PROCESS AND I'M STILL WAITING AFTER 4 WEEKS and still no SS CARD)
So, as you can see, that's why you have to prove you can pay for your wifes vacations while waiting for her green card and ss number.
I say it takes (since you mailed the paperwork) around 4 months to 9 months.
You can find a very good example case at the second link but this was around 2001 and as i told you it's a little different but it has very good timings and examples, i used it all the way.

if you get married... he'll have a right to be here with you... there's a lot of paperwork involved... the other poster was right... get an immigration lawyer to help you out... because if the forms are filled out wrong it could mess things up... also... the time really depends on your husband/fiance/boyfriend... the country he was born in... his name and if anyone else has his name... all these things effect the time... if hes from a "non threat country" it could be as little as 3-9 months... if he's from a "higher risk" country it could take years... but there paperwork to file in the interim... check the link posted above it should help.

When your husband files the petition for Adjustment of Status(AOS), don't forget to apply for Employment Authorization.
He will probably get his work permit in 3 months after filing the petition for AOS. And if he doesn't get his work permit in 3 months. He can go to a local immigration office and get a temporary work permit.
* By the way, he can get a work permit before getting his green card. Well, I got my work permit before I did my interview and got my green card. Anyway, he will get the Notice of Action after filing the petition for AOS. And the Notice of Action will tell him how long it will take him to get his work permit.

The first poster is correct. If INS stuff is too much of a pain in the butt for you, contact an immigration attorney in the area of CA you are moving to.

if you get married and he has a visa to be here in the first place, it usualy takes 6 months
