Sunrayman: you're going to get all the dog lovers hot and bothered about this question. Be clear, though, Police dogs are NOT attack dogs; they are highly trained partners in crime detection and prevention. They do not attack randomly; only on specific command from their handlers. If a police dog handler orders his dog to menace or hold you, he will do everything short of attacking to scare the crap out of you. If you react in any way but submission...on your head be it.

NO, murder is the unlawful killing of a HUMAN BEING! Dogs, or any other animal, do not count, no matter what they do. Are you serious? Are you sure it's a murder charge? I would guess you face an attempted murder of the officer. I am unaware of any state that has a different law than NC regarding the definition of murder. So, take a good look at your paperwork, ask your attorney. If you don't have one, HIRE ONE!

The dogs in the Canine Patrol are considered law enforcement.. If you kill one, you are in effect, murdering an officer of the law.
I would wonder why, if one is being told to surrender, one would; a) not stop immediately and assume the position - especially if being pursued by the dog, and; b) pull a weapon and start shooting.
You reap what you sow.....

Have you ever watched Cops? If not, I recommend that you do so.
I have friends who are cops, and they always announce the fact that they are using a K-9, and sometimes announce it two or three times. A K-9 is an officer of the law, specially trained. They go through academy training just like human officers do. They have badges that are clipped to their collars. They also have names, just like human officers. They are not trained to kill. They are trained to detain and control until their partner arrives and takes control of the situation.
I say, you deserve whatever you get for hurting one of the officers, two legs or four!!

Most states (and the Military) passed laws stating that police dogs are sworn peace officers and have more rights than ordinary dogs because of the lengthy and specialized training (not just to be attack dogs). So yes, its the same as shooting a cop.

You bring up a very common problem because records show that a majority of police dog bites were because someone couldn't comply with the officers comand because of the police dogs incessant barking and they couldn't understand or hear what the officer was saying or comanding them to do. There are also cases the canine units don't want made public because they prove conclusively that the handler/officer maliciously allowed or comanded the dog to attack just to watch the police dog attack and tear someone up. To contradict an officer of any agency will only result in officers fileing false reports to back-up their own, and in a vast number there are exagerated or inflamatory statements made by fellow officers. Police Dogs are only as effective as their handlers and to hurt one even defending yourself a (natural instinct), is to be charged as if you assaulted a police officer.

Thanks for the two points doofus. A K-9 is considered a police officer in most places nowdays. You take him down and it is just like taking down the K-9 handler. When the cop yells stop.....STOP and he won't send the dog after your dumb azz. When the cop yells come out with your hands up...COME OUT and he won't send in the dog after your dumb azz. If you want more ways to avoid being arrested, Google "Chris Rock How Not To Get Arrested" and watch the instructional video. "If the cops have to run after you...they are bringin an azz whoopin with them."

My father was a policeman (now deceased). We had policedogs. They are considered Officers of the law. You do not have the right to kill them. They are there to protect & serve. These dogs are not trained to kill, but to attack until officers can take over. Most policemen are not cowards. They are heroes who put their life on the line everyday for You.

Actually, think about what you just said. You will be CHARGED with murder, not convicted on the spot. So yes, you would be charged but would go through a trial so a person would be able to tell what happened.
