Question, can a baby born in November 06 be claimed as a dependent? If so, can you get EIC for the baby?

As long as the baby is born in 2006 you can claim it as a dependent. Whether you qualify for EIC depends on your income, family size and filing status.

Income thresholds:

1 child

less than $32,001 ($34,001 if Married Filing Jointly)

2 children

less than $36,348 ($38,348 if Married Filing Jointly)

Assuming you have earned income (that is the first requirement to qualify for the EIC), the child would qualify you for the higher earned income credit. As long as the child was born on or before December 31, they are a dependent for the full year.

If your child was born by 12/30/2006, that child is your dependent, and you would say they lived with you 12 months for tax purposes. This must be your child and there are several other guidelines as to what a dependent is.
