My husband and I bought a home 10/06. His parents moved in with us in 12/06. My father in law is retired and my mother in law is on disability. I know I can't claim them in 06 taxes but should I claim them in 2007? Any advice would be appreciated

my father in law receives SSI and my mother in law receives disability. We have 2 children. They are not going to file taxes due to low income.

What type of income do your parents have? A pension? Medicare? A disability check? These are all important factors in determining if you are eligible to claim them in any year. Typically you have to prove that you have paid for more that 1/2 of their living expeness. For the govt. requires you to calculate. How much is 1/2 of all your utilities for the year. How much would you get for rent if you were to have rented the room/bathroom your parents use. Who buys grocery's are there children in the house as well. If it comes down to, your parents make less than 1/2 of what you are providing them, then you can claim them.

You should also talk to your parents about this, in case they have intensions of filing a return themselves.

It come down to are you legally able to claim them, due to your numbers, Not who is right or wrong, and not how is it going to make someone feel.

You may need to talk to an accountant to get the breakdown, you will have to provide them with a copy of your and your parents most recent tax returns. Good Luck.

If the SSI and disability are their only income, then you might be able to claim them. You'd have to calculate what percentage of their support you provide - if it's over half, then yes you can. There's a worksheet on page 32 of IRS Publication 17 (download at irs.gov) that you can use to calculate what percent of support you pay.

I claimed my Mother( she was over 65 though). She lived with me, only source of income was social security (less the 800 monthly). If you provide more than 50% of their support then you can claim them as dependents. The safest way to find out, however, would be to go on the IRS website, or ask your tax guy/gal.

Only if you provided for them completely, and they're over 65 and blind.
My guess is, you can't. because you're mother-in-law is receiving disability and your father is probably on some sort of pension so you couldn't be providing the majority of their support.

But you might be able to get a deduction for EIC since they are living in your home..

you CAN claim your in-laws in 2006 if you provided more than 50% of their support AND they had gross income of less than $3,300 each. this does not include non-taxable SSI/disability income.

Your parents DID NOT have to live with you in order to be eligible.
