My brother called the student loan company and the IRS they said he can get his taxes back that they garnish from him. But he will have to write a letter of hardship and get a court order of hardship.My question is has anybody done this and does it work?? I dont want him to get his hopes up!

I used to work for a student loan guarantor (the agency that has the tax refund and wages garnished if one defaults on their student loans) and I have never heard of this. That's not to say it isn't possible, but a lot hoops would most likely have be jumped through as technically, the government is keeping money that is owed them. I wouldn't count on him getting the money back as it really isn't his as he owes a government loan.

Wages, sure, taxes, a minimum of federal...NO. If it truly is what they're threatening you with, pay no heed to it. they can and could, notwithstanding, garnish any wages you're entitled to after triumphing a lawsuit.

wouldnt bother, by the time he gets it he'll be dead and wont need it.
