I took someones debit card to get food and gas for my kids this is my first offense will I go to jail it was under $400

Darn right, Genghis K. MOST people don't do things like this. Being poor is NO excuse for breaking the law. There are MANY other ways to get food for your children than to steal someone's ATM card. CRIPES.

Now to the poster: You screwed up big time. There is never an excuse to steal. Never. You have a computer and an Internet connection so you can't be THAT poor. I have no sympathy for you. Your children? Yes. They should be in child protective services because their parent is a thief.

Yes, you should get some jail time. But I have a feeling if this is really your first offense and there are no other charges pending on you relating to this, that you will get 3 years in jail with all of it suspended and you will be on supervised probation for a year. Then 5 years of good behavior and then it will be over. You will ALWAYS be a convicted felon, though. And that will make it very hard for you to get a job. You can't vote. It's a real shame.

Most likely not. A suspended sentence and probation. May be required to make restitution and do community service.

i certainly hope so. you must learn that taking something that is not your own is criminal. what is so scary is that you have children.

dont listen to them, **** them. it is obvious none of these people have been in trouble. dont worry about it just dont do it again
