The only legal way to fill without a W-2 from your employer is using a substitute W-2 from the IRS. Requesting the form from the IRS has the same effect as filing a complaint against your employer.

You do need your W-2 because you'll need the information to file a return esp. electronically. Also, you want to make sure the information matches to the numbers on your last paystub.
The W-2 has information such as your earnings and withholding as well as your employer's information which is needed to be filled in if you plan on filing electronically.
If you choose to efile your return, then you don't need to file a copy of your W-2 with the return. You still need the W-2 info just to fill in the information.
If you plan on filing a paper return, then you would need a copy of the W-2 since a copy of it must be filed with the return.
Just ask your employer if one was sent. If so, check the address to where it was sent. If not, ask for a copy.

When you fill out the FAFSA it is only for the previous year, so nothing that you did in 200, 2005, 0\or 2007 has anything to do with this. Select Will Not File from the drop down menu when you fill out the FAFSA. This will automatically flag you for verification, so I would go ahead and download the verification form from your school's financial aid website if I were you, and fill it out. There you will list any money that you made in the previous year, so any money that you did make in 2009 on the appropriate line.

If you eFile. Paper filing you have to attach the W-2.
However, I wouldn't recommend it. If the employer made some last minute adjustments when the W-2s were prepared, the actual numbers will be different than the pay stub.

You'll need your W-2 because you'll need to attach it to your tax return. The real question is why you don't have your W-2? There's certainly no harm in calling your employer (or former employer) and telling him that you never received it. Just make sure that it's being mailed to the correct address.
