As you may have figured out, there is no answer that is going to be right everywhere. If there is a particular State you are interested in, let us know. I can tell you that in California consensual sex between two people if both are under 18 and over 14 is not a criminal offense, but, oddly, oral sex with anybody under 18, even if both are under 18, is a crime. I've never seen it prosecuted, but there it is.

Each state has a different type of law for this. In most states sixteen and under is statutory rape and most of the time a felony. If the 16 year old agrees to sex with the eighteen year old and the 16's parents find out and file charges the 18 could do up to 5 years and sometimes more. I also know that some states will put these kids on the sex offenders list and they will be considered a predator by society. Very ridiculous and unfair, but the law.

That depends on the "age of consent" laws in a specific state... They arent all the same (hardly) Males & females differ as to age as to 'consent age" in most of them... and as we all know a minor isnt always a minor (16 tried as an adult???) There is no "STANDARD" in the USA on almost any law... I wish there were actually.. the we could all be on the same sheet of music on everything all the time.. but thats not the way it is...

EXAMPLE: 17 year old busts a cap in some ones ***.. Tried as an adult for murder.. same 17 year old has sex with another 17 year old?? (or worse a 30 year old teacher somewhere) tried as a Juvi and released... but the teacher goes to Jail??? makes no sense to me.

Pick a spot and a position and stick to it .. this is totally illogical..

Make up my mind people would ya?

I don't think anything happens if they're both minors. If one is an adult and the other is a minor, though, it's statutory rape and the older person can go to jail. The minor's parent can press charges. I may be wrong about that, but I think that's the way it is.

It depends on the state law that applies, especially if the younger child is under the age of consent, or if force was involved, or if there was physical harm to the younger minor.

Laws vary by state, but usually they have to be within 2 years of each other (i.e. a 15 year old and a 17 year old).

Hopefully nobody would ever get convicted of statutory rape, however there are a bunch of retards out there that think its ok to imprison people based on this law.

Its ok to marry somebody thats 50 when your 18 but not okay to bang sombody thats 16 when your 18. Somebody please explain the logic in that to me?

Minors should not be having sex. Be smart - don't start until you know when to make safe choices.
