It depends... Is your fiance' inside or outside the United States? Do you want to get married inside or outside the US? Are you just wondering about a K3 Visa so he or she can enter the country to wait for an approval on a pending I-130?

I am going to assume he or she is outside the US & you want to bring them inside.

You will need to file the form I-129F, Petition for a Fiance'. You can download the form from the USCIS website listed above, at http://www.uscis.gov . There will be in depth instructions on the form, as to what you need to include, the filing fee, where to send, etc. If you have questions while you are completing the form, just check the website or call USCIS Customer Service Line for assistance at 1-800-375-5283. They cannot tell you WHAT to put on the form, but they can help you to better understand it.

In addition to filing the I-129F, you also have to meet USCIS Standards, such as meeting your fiance' in the past 2 years, being legally free to wed, etc. You will also need the form G-325A, which is for you & your fiance's Biographic Information. This form is not absolutely necessary when first filing the petition, however, they will ask for it at a later time which could delay the processing, so you may want to complete it & send it with the petition. There is no filing fee for the G-325A.

Once the I-129F is approved, it will be sent to the State Department's National Visa Center, who will pre process it and forward it to the appropriate US Embassy or Consulate overseas. There, they will contact your fiance' & invite him/her in for him/her medical examinations & tell him.her of any additional paperwork that could be required there. He/She will then receive her visa to come to the US to marry you.

Your fiance must marry you within 90 days. Failure to do so means he or she will automatically have to depart. You cannot extend this status nor change it, unless you do marry. You cannot marry someone else either.

Yes, people can get them but they are only good for 90 days, so you have to make up your mind! Most of the time, you cannot get one unless you visit the person in their land before applying!

why dont you call immigration at 1800-375-5283 and asked them what you need
