Can my brother get in trouble with the Army if he is married but is having an affair with a girl that in his company/platoon?

They could both get into trouble and even dishonarably discharged.

Yep.... sure can. The military is not the civilian world. Anything that might possibly be a detriment to unit readiness or cohesivness can be dealt with sharply if they chose to do so.

Bsically it would be like holding something over ones head. A coworker or a boss who disapproves could at any time bust him out. Even if it within the enlisted ranks and he has a higher rank it could be viewed as wrong. The military would ask if he was using his position wisely even if it is consensual. Other soldiers may say she is getting preferential treatment even if that is not the case. OR............ if this girl gets pissed off at him she can cast accusations.

So all in all the militarys policies are simple as they would rather censure the person rather than sort it out. Up to a dishonorable or other than honorable discharge in which case he will be screwed even in civilian life forever..... all for a bit of fun.

Promotions and performance ratings within the military? Well people always know everybodies business and adultery will slow him down even if it doesn't come out in the open. This happens all of the time as it is always some soldier who says "I didn't know".

Tell you brother to keep at it if he is that stupid. Screw up his whole life, marriage and career. So he should appreciate the fun he is having now because he will need it later when life is not so fun. Some get it and some don't.

Yes, first off he's married...that's strike one! He (and his mistress) can both be punished and/or dishonorably discharged from service for either fraternization (depends on rank and what they are to each other subordinate to superior and so on) or adultery or BOTH!! That means no benefits whatsoever. All GI Bill payments will never be recouped for both.
Second, if wifey finds out...look out!! She can heap a load of trouble on him and his life depending on how long they have been married and if he doesn't get discharged!

All in all, tell your brother to end this taboo relationship, put his best friend back in his pants and go see a marriage counselor w/ his wife. I saw too many of these relationships destroy lives and all for what? A little nookie or even great sex?!? Not worth it!!!

Yes, very much so. Adultery is a felony in the Military. Your brother could be brought up on UCMJ for court martial, and possibly prison.

Yes he can babe. According to the UCMJ (Uniform Code of Military Justice) he can be tried for adultery. Also, he can be charger with insubordination depending on his and her rank.

yes, but it's on the Army and his wife to prove it with either a confession or picture/video evidence.

yes he will be charged with fraternizing and adultery. the military forbids service members from dating each other
