File a paper return if you can not efile due to someone else claiming a dependant.

When 2 people claim the same child on a tax return, It raises a flag with the IRS. They will first send a letter advising that the same SSN was used twice and advise that the person who was not entitled to claim the child needs to file an amended return. Then if no one corrects the return the IRS will request from both parties to submit proof of entitlement to claim the child. The IRS will then make a detemination on who is entitled to claim the child and it the person who is seen as the one NOT allowed to claim the child will owe back any refund they received in reference to the child along with penalties and interest and their Tax return will be flagged for review for up to the next 10 years

You can't. And the IRS will only tell you that a dependent you claimed has been claimed by another person at the time the IRS processes the return. And you can't find out who claimed the child. It's a matter between the IRS and the other person.

I found out in December from the IRS that on my 2006 Tax REturn someone else had used my childrens SS numbers. ALl they did was ask me to amend my return if it was wrong and do nothing if it was correct. They sent the same message to their father who was the one that used the children. Since he was the one that should not have used them, I have them 12 months out of the year and he rarely pays child support, he will have to amend his tax return. If you need to know sooner, I am sure you can call their toll free number and ask them.
