We have 2 children together, I need to know if I can claim one child and he can claim the other, and if I will get back more if I file seperately, or should I file with him jointly??

You could file jointy and have the refund deposited into your account and his, as the IRS allows now to have the refund direct deposited into up to 3 bank accounts now. Filing jointly would give you both full advantage of all of the Credits that you would be able to claim. Filing Separate may disallow you to claim certain credits,which in turn could lower your refund amount.
But if you do not want to be responsible for any Tax debt that he might incur then file Separately.
It makes more sense to file Jointly

If you file seperately, neither of you will get the Earned Income Credit and that could lose you over $4000 together if you qualify for it. I would file together and figure out a way to split it where you each get more than if you file seperately. File jointly and you will get more money. you can do this until you are officially divorced, and then you will each be able to get the Earned Income Credit after the divorce.

You'd make more if you filed jointly, but the problem is we don't know how your relationship with your husband is. If he insists on having the return direct deposited in his account he could blow you off as far as giving you your fair share. So if you can trust your husband to do right by you, file jointly. Otherwise, file separately and claim one child each.

If you file separately, you are allowed to each claim one child, or have one or the other of you claim both of them.

If you can agree, filing joint would almost surely be better financially.

it depends if you lived with him at any time in 06 and your income
if you qualify for the earned income credit and you are filing seperately you cannot claim the credit.

file seperately and claim one child. You should get back more money this way.
