When 2 people claim the same child on a tax return, It raises a flag with the IRS. They will first send a letter advising that the same SSN was used twice and advise that the person who was not entitled to claim the child needs to file an amended return. Then if no one corrects the return the IRS will request from both parties to submit proof of entitlement to claim the child. The IRS will then make a detemination on who is entitled to claim the child and it the person who is seen as the one NOT allowed to claim the child will owe back any refund they received in reference to the child along with penalties and interest and their Tax return will be flagged for review for up to the next 10 years

You will receive a letter that the SSN was already claimed. You have to call the IRS and explain the situation. This happened to me. I also sent a paper return as required in the letter, and documents that proved that I was the caretaker. An IRS agent did an investigation and determine that the other person was at fault. They were audited.

I would call the IRS to get the process started. The sooner you report it, the better. 1-800-829-1040

Nobody will probably be audited because of this, but both people will be asked to prove that they are the one with the right to claim the child. Then the person who was NOT entitled to claim the child will have to pay back the money plus interest and possible penalties.

Unfortunately, if the other person filed first, your refund would probably be delayed.

you cant say for sure if someone would be audited because my sister actually claimed a friends kids, with permission from the friend because the friend didnt work, but the irs did catch it of course and they simply asked her to prove she was entitled to claim them,which she wasnt, and they figured up how much she owed and made her pay it back with intrest. They didnt arrest her or audit her.

The IRS will come calling to both of you! It isn't an "audit." It will be a tax notice requesting info.

Who is suppose to get the kid? If a persona claims the child and isn't suppose to have him, they will have to amend their return and pay the extra taxes. THEY are in trouble

This won't necessarily cause an audit, per se, but the IRS will catch it. They will notify both of you of the problem and will ask each of you to document why you are the rightful person to claim this dependent. If someone has used a SS# fraudulently, they could be subject to severe penalties.

Both parties will be contacted. Get child support agreements, birth certificates, court orders, school records, etc. together. Don't ignore any correspondence from the IRS.

Probably nobody. You'll both be asked to provide proof of entitlement to the exemption. The IRS will then decide who gets the exemption.

The non-custodial parent, sometimes both will be audited to sort things out.

if it is your kid and you are coustodial--they would be audited and possibly arrested
