I am not eligible for disability because I could work at an easier job. My problem? I have 29.55 years in the school system and need 30 years to get any kind of decent retirement. Now I will get 43% as opposed to 6o% if I can go another 4 and a half months. My doc says I can't .How can I get someone to help me?

Get a GOOD LAWYER- someone out of your town and who specializes in disability --- your first visit is free- he will advise you on how to handle this situation- he may just right a letter or talk to your doctor--- there has to be some way you can get that 4 1/2 months- if you were pregnant, you would get maternity leave, wouldn't you? that time would still count toward your time of service for pension benefits--- these are answers an attorney can help you with.....please call.....again, someone out of your local area and get a big name--- like one of the biggest specializing in disability that is listed in your phone book...........good luck to you.

I think most of the responders missed the point. Your problem is not with the school district, IT IS WITH YOUR DOCTOR. You need to sit down with your doctor and find out why he says you cannot finish the next 4.5 months in your current position. He can restrict your activities and the school will most likely accomodate your disability, especially since you will be vacating your post in such a short time.

You have other protections as well. FMLA is one of them. You need to sit down with the Human Resources Director and explain your situation. They can tell you what the school can and cannot do.

In the meantime, you may need to get a second opinion from another doctor before you throw away everything based on his diagnosis. I am not saying he is wrong, and I don't know what your illness is, but I do know taking the first diagnosis as gospel is not the right thing to do.

Go to work any way? What a doctor says and what reality says are most often than not at odds with one another. Will 5 months of teaching seriously impair your health? Work with your district to make a plan so you can retire with a better income. If that doesn't work go the hard route with the lawyer, but that will be expensive, time consuming, and almost like work.

Do you have any sick days or vacation days left? Can you take a leave of absence maybe your doctor or another doctor will write you a letter. Go back to work at the school doing something else. Lunch room, custodial, bus driver, aid or anything you can as long is it is in the school system. Just take a cut in pay or whatever you have to do. You can do that for 4 months maybe. Don't they have to keep you as long as you are not fully disable? You definitely need to seek legal advice here!!! That is a bum deal!!!

Isn't there a thing called "Shared Leave" in the school system? I know there is in the state government system. I'd check into "shared Leave". Also get your union involved and try calling the Superintendant of Instruction. I'm sure you've already contacted your principal, so ever upward to his/her supervisor, etc. Also check with Retirement and see if you can buy retirement credits-I was PERS2 and I purchased credits, so I'd get a better retirement benefit.

talk with the Superintendant of your school system to see if something can be worked out, like a 4 hour job in the office, or something. You deserve your full retirement.

Yep - contact an attorney and see if you can go to a different doc or perhaps a specialist. On the other hand, if working could cause you to become even more disable or even die, then to me, it aint worth it.

You should look into maybe seeing if you could teach kids from home, it wouldn't be the same kids i'm sure, bu you could probably still get your beefits if that were to work out.

Contact a lawyer and they should help u with this. I know its going to be rough and one of the hardest things to do, but u have to think positive and think a good lawyer will help u. Good Luck!!!

What about as an assistant or in the office? It would be with the same school district.Would that work?
