They wouldn't even let me go to sleep the whole time. I had no food and limited water. They came into my room while I was sleeping, handcuffed me, took me to the station, unhandcuffed me, searched me, made me give them my socks and pajama top, and handcuffed me again. I spent the next day and a half handcuffed and freezing to death in a camisole and pajama bottoms.

I wasn't even "guilty" of anything, they were asking me questions about my dad that I could not answer. I wasn't even officially arrested. ALSO, they were telling me blatant lies in an attempt to get me to answer. When I begged them to take the cuffs off, they said they only would if I would make a written statement incriminating my father.

I'm an honor student, in the United States, and my dad is an executive at a fairly large energy company. How can this happen? My dad is still being questioned... I have no idea where to go to find out my rights (my dad usually handles this), but this MUST be illegal, right?

Why were you arrested? Unless you were under formal arrest they had no right to handcuff and treat you in this manner. Were you suspected of a crime as well? (No judgment, I just might be able to better point you in the right direction)/

Get a lawyer and do not answer ANY questions. Tell your dad to do the same. If cops try to questions you, tell them you will NOT speak to them without an attorney. If they try anything after that, then you have grounds for a civil complaint. It may be an uphill battle, but it's always good to make a record of corruption if nothing else.

Once your dad gets a lawyer, they won't try to question you any longer.

You probably still have grounds for making a complaint about what happened to you.

As for them telling you blatant lies to get you to talk, they are legally allowed to do that.

Ok....this may be long but bear with me.
First off I work for a sheriff's office and i am a volunteer fireman along with my father being the number 1 assistant district attorney for the two parishes he serves in including the one we live in. I'm not quite sure why you were arrested but I can tell you this; in a way their right and in another their wrong.

Its is in their discretion wether or not you should be handcuffed or not due to safety reasons for you and them. It is also perfectly legal for them to incriminate you for evidence since that is our job, to get evidence and as long as they do it in a lawful manner.
However it is unlawful to hold someone prisoner and incriminate a person for something they honestly know nothing about. First when they arrested you they should have served a proper arrest warrant issued by the District Attorney or the Sheriff or preciding judge unless you ran from them earlier and they were in pursuit of you. As for as taking your clothes that is another mishap. If they make you remove clothing they must then provide you clothing to replace what you gave them, a shirt for a shirt, pants for pants, bra for a bra, etc. As for a placing you in a cold room that is legal, there is no way you can get on to them for placing you in a room like that, that may be the only one available. They can lie to you all they want to get the information as long as they dont provide false evidence to prove their accusation.
You have been denied some rights of personal and civil process and while i work for a sheriffs office I will tell you that you really need to check into this matter because something is not adding up. I think that you have been falsely imprisoned and not given your due respect as a citizen under arrest. If you have anymore questions just let me know, I'm more than happy to help.

Okay, the 'money and privilege thing' doesn't make you immune to the law. If they held you for thirty hours, denied you food and you had limited water, those things create a legal basis for holding them accountable. They treated you with disrespect and handled you in an abusive manner.

Noone deserves to be treated this way. They have no right to turn you against your father in a manipulative and deceitful manner for their own gain, at your expense. The other stuff are bases for filing a lawsuit and requesting an investigation. So sorry for you and good luck..

Contact the Civil Liberties Union in your home State. Look around your Dads home office under the A's for attorney or L's for lawyer. Give ONLY a brief statement to him and see if he can help. Alot of attorneys are leery of dealing with 4th Amendment Issues, but From what I've read I would contact the Internal Affairs Department and give them the officers/detectives names and/or badge #'s that refused to uphold your 4th Amendment Rights. Didn't you "At AnyTime" ask for an attorney or phonecall?
One last suggestion,, DON'T DISCUSS THIS WITH ANYONE BUT AN ATTORNEY!!!!! My Prayers to You.

I think it is agaisnt the law for them to do that if you weren't arrested. If not, then it still is definately a tort issue, and you can sue

when in jail it is not the holiday inn and yes they can keeep ypoi handcuffed what harm are they doing they are not beating you if it was a high risk crime I would

Hmmm did they even have a search warrant? Are you a minor? They shouldn't have treated you this way . SO sorry for you and your father.

They will do this if they feel you can be a risk to them, or any other people who may be close. A cop will treat you how you treat them.
