i am in 2 minds go thai and marry or bring her as tourist then marry in australia does any body know the immigration law of getting married to a tourist

yeah, been in that....
answer your question: it doesn't matter which way you do it.
either way, she will have to wait in Thailand for her spouse visa.
in Australia you can marry any consenting adult, regardless of their visa status.
overview: when you're dealing with Immigration tell the truth....if they find a discrepancy further down the track you're stuffed.
for example, if she has been married before make sure she has divorce certificate....don't try to fudge the big issues.
two things are critically important: the length of the relationship, and that it is demonstrably genuine.
so, keep records of emails, phone calls, gifts, financial assistance, visits.
your best chance: a relationship of at least 12 months, preferably !8 months, and two visits....you to her or her to you....
married, of course....have photos of your time together, and evidence of shared interests and commitment to each other...
and friends and family who approve of the marriage.

If you are asking about US law, she still could not legally come here just because you got married. You would have to do her paperwork with her there. You could apply for her to come here on a K1 fiance visa. If approve then once she arrives here you have to be married within 90 days. After that you would have to file paperwork to adjust her status.
