Having sex with a child under the age 14 is a felony in pretty much all US states. Consent laws usually start at 15 where you can get into trouble for statutory rape, so yeah you can go to jail (and maybe prison.) It's best to wait awhile before these two individuals get sexually involved.

It definitely depends on the state you happen to be in at the time. Iowa and Hawaii set the age of maturity for sex at 14. Most of the New England states are 16, and some states such as New York, require that minors (below 21) be within 3 years of each other. Still, others, such as New Jersey, set a hard line at 18. South Carolina, oddly enough sets the bar at 18, unless a party is no longer a virgin, at which point they set the bar at 12. Know your state, and look up the statute. Whatever you do, do not drive her over a state line to seek a better rule. That's kidnapping a minor, which is conspicuously worse than statutory rape.

I believe that the seventeen year old male is a pervert and the thirteen year old girl is a child in need of psychiatric intervention.
