IS there any grace period to sell alcohol after Midnight... Sometimes when working nightshift at our store, People will walk in in large numbers 5 minutes before midnight, They get beer and queu up and time expires while on the queu.. I always find myself selling the alcohol as late as 3-5 minutes after time.....

Can i be arrested for selling beer 3 minutes after time... Also is it illegal to deny beer purchases 5 minutes before midnight...

Ok.....I used to tend bar in Houston so I have an answer for you. If it is after midnight the sale is illegal. Period. However, you won't get arrested just ticketed. Secondly, it is NEVER illegal to deny beer purchases. You as a retailer(or employee or a retailer) can refuse anyone for any reason (as long as its not discriminitory.) So if your boss says NO one buys beers after 11:55 or 11:30 or even after 9:00 its perfectly legal.

Actually I do not think that they will arrest you but you could get a ding on your liquor liscence. If the purchase is not in the register by midnight then yes the TABC can take action against you. It is not very common. It usually happens to places that already have a reputation for selling after hours.
