I have a daughter that leaves with me, she has 2 daughters one is 3 yrs. old and the other one is 7 days old. The grandmother from the father side has filed for custody for no reason. She has lied to the courts about my daughter abusing the 3 yr. old daughter and being an unfit parent this lady has harrased us ever since my daughter got pregnant about taking custody of the baby, this lady has lied and even hit my daughter. She has called ACS on us for no reason. The have closed the cases because it was unfounded. We also filed a report on the lady way before the baby was born for harrasement on taking custody of the baby. She has also said that she can win the case because she has for money than us. My daughter is 18 yrs. old and goes to school and does take very well care of her children right now we don't have money for a good lawyer. So, I would like to know if she could really get custody? The baby's father is also against is own mother because he knows that his mother is wrong.

My dauther has never abused my granddaughter or neglected them. I really don't know why this lady is doing this. It's really stressing the family. I have faith that we will win the case.

First of all, even if custody was taken from your daughter and given to a grandmother, I'm sure you would be the first to get it. They have to prove a mother is unfit, and it sounds as if the ACS already knows your daughter is not unfit. I don't think she has a chance at all in getting custody. It already sounds as if the ACS knows what this lady is all about. I'm glad to hear that you filed harassment charges against her, but don't stop there, she is also breaking the law by slandering your daughters reputation. By the sounds of it, this woman is mentally not stable, and I'm sure this isn't going to be hard for the authorities to figure out. Best of wishes.....congratulations on being a grandma once again.

Yes a grandparent can get custody of a child. If I was you I would start to write down everything like when she calls what was said ect......You need dates and times as it looks better on you in court. The good thing is that your daughter has the babies dad on her side. Has papers already been filed? If not tell you daughter and her B/F to go to court and get custody of the kids right away. If papers have be filed already you can not do that. I wish you the best of luck and if you need to know anything you can ask me. Remember 1 thing money means nothing it is love that matters so if she has lots of money but does not love them she will NOT get them at all

Yes she can get costody, but from what I am reading I don't think she has a very good case. Get your daughter to file for the legal aid lawyer, it will be approved because she has no income or very little. Go with her to the lawyer, tell them everything you have told me here. Especially about the harrassment and her hitting your daughter and make sure you get a copy of the harrassment charge and give this to the lawyer. The lawyer will help you and if possible, get the father of the child to go with you and make sure he keeps this info to himself. Once the lawyer knows that the three of you are working together to make sure the dad's mother doesn't get custody, you will have a very strong case. Please do this ASAP. yes a grandmother can get custody...but for anyone to take custody away from a mother they have to prove the mother is unfit...very hard to prove if children are not being abused.
most cities in most states have something called Legal Aid for people who can not afford a lawyer on their own....might be something for you to look into.
