Could someone pls explain to me, step by step, and in easy terms, what should I do to get my "time off". I am so confused with so many acronyms and HR dept. at work is no help at all. I amin California, and meet all the time requieremntes to get full benefits. No vacation, or sick days though. Im due on March 31st. Its very likely that Ill need to leave work the first week of march (because of medical reasons) so... Do i need two separate forms? one for PDL and one for after baby is born for FMLA (new child leave) ? Or one stating that when I am leaving and when I am coming back is enough?? Plus, Who send this info to the state?? Work just gave me a form for FMLA, and another for the doctor to fill out....is there something else I have to check on??? how many "paid" weeks do i get?? the 4 weeks previous to birth, 6 weeks after birth and then 12 weeks without pay?? PLEASE HELP in your own words.... websites are so confusing..

okay...FMLA just states that...if you've worked for an employer for a year or more and need to take a leave of absence for any kind of reason due to anything related to your family (i believe this only applies to immediate types of family members and yourself) that your employer has to guarantee you 12 weeks off, unpaid, within a twelve month period of time. in other words, you are guaranteed not to lose your job if you have to take up to a 12 week leave of absence for family reasons per year of employment. but, they do not have to pay you. if you have short term disability benefits or if your employer offers paid maternity leave, you will get paid for your leave. if you go on leave before you actually go into labor, your HR dept. will need notification from your doctor that he/she has ordered you off of work. then, after you have the baby, you will go to the dr. for a follow up visit like 4 weeks later and he/she will determine when you can return to work. you need notification of that date and give that to your HR dept. theoretically, your employer does not have to guarantee you 12 weeks unpaid on top of your leave... they only have to hold your job for 12 weeks whether they pay you or not. but...you can take the full 12 weeks (total) if you want to. like 4 weeks prior, 6 weeks after with pay and 2 weeks without.

when i was 30 weeks pregnant i had to go out for medical reasons and went on disability...my plan was to take my 12 weeks fmla after having my daughter...after she was born i found out my workplace has a policy that if you are on disability it cuts into your fmla...so when i thought i had 12 weeks fmla i actually only had 2....so after taking my 6 weeks post delivery disability and my 2 weeks fmla,i had to take a leave of absence,which was a better option for me being the way our contract was worded and such....had i chosen to go back to work i would have ended up with 7 months time off after my daughter was born...6 weeks dbl,2 weeks fmla and a 6 month leave of absence...i ended up resigning while on the leave of absence to stay home with my daughter.

you will need to get whatever forms your employer requires and have them filled in by your ob/gyn,i also gave my doc a couple stamped addressed envelopes so he could just send the paperwork in..that was all i had to do

the people who handle the disability for my work place then called me and sent me other stuff,she called me every week asking if i was going back to work before delivery,which i did not...and the day she was born i had to call them and tell them when she was born because the amount of my disability changed and it changed to post delivery status


as for being paid while out before having the baby if you have disability insurance through your job that should cover you
