If someone hits a piece of slush/ice and goes into the ditch and hours later someone else hits the same slippery spot and hits the other car still in the ditch. who is responsible for the damages? Is a no fault ( you each pay for your own)?

Ok, every answer so far has been wrong so ill give you the correct answer.

Both cars have some negligence for driving unsafely for weather conditions. The first car's insurance will have to pay all damages associated with the first cars first accident (going into the ditch)

The second car will not only pay its own damages but pay the damages it caused when it hit the second car on its way to the ditch as well.

Both may be considered an act of God! So sue God. Insurances will pay their own. But may lay a claim against the other driver for the difference between what the first accident caused and the second added to. It is mainly between the two insurnace companies to come to an agreement.

Both,First one should try to get the car out or put up a signal.Second one is definitely to be blamed can't see a car in the ditch,come on.

Both drivers would likely be ticketed with excessive speed for conditions and each would be responsible for their own damages.

Here where I live both drivers are responsible because they have not adapted their speed to the driving conditions.

Its the first cars fault for two reasons... first reason is the first person in the ditch should have had their car removed from the ditch right away not wait for hours to have it removed besides, its not legal to park in a ditch!. second, the first car to slip on the ice and end up in the ditch should have spread sand or salt on the ice patch to help others so they should slip. So the first car should pay the second cars expenses lost wages injuries and car damages in full! I bet it was a females car that ended up in the ditch first as a guy would know better

Both drivers were driving too fast for conditions and are responsible for the damage that they caused.
