So if the answer is yes, then how do I proceed? The bail company said I had to sue the police dept for false arrest?

Even if the charges are dropped - your friend can expunge those records depending on which state.

Expunging the records does not mean that the bondsman will refund his fee - that was his price for posting bond to release your friend. Sorry....

i don't see how charges can be dropped 15 mins after posting bond. the process is usually that the person gets arrested; bail is set depending on the infraction; he/she stays in jail if unable to post bail/bond or released if able to pay. A court date is then set. it is at this hearing that the charges can be dropped and the monies returned.

You paid the bondsman to provide a service (posting bail). The court returns the bail to the bondsman if the charges are dropped. As long as the bondsman actually posted bail, they get paid for providing a service.

Generally speaking, when money is paid to a bonding agent, the agent advises the bail has been posted to the court of venue. Even if your friend is released immediately, the bail bonding agent has completed his responsibility and is entitled to keep the amount charged for the bond. Like tha agent said, if the arrest was illegal, the arrestee's recourse is to sue for false arrest. However, good luck.

Yes, however the bondsman may charge a modest fee for their services. After all they did do the work.
