i recently split with my husband- he is the father of my son, but not my daughter. i want to claim tax credits for myself and my daughter, as i only work parttime. problem is, me and my husband are still living in the marital home, as it is jointly owned. he is willing to pay for our son, but not my daughter. her biological father is not on the scene (he hasn't seen her for yearsand i nelieve he is in prison). am i entitled?

There is a few difficulties in this, but yes depending on your income you should be able.

Firstly you have to be working over 16 hours per week and getting the Child Bebefit in your name. Secondly you will have to claim for both children, the maintence from your ex partner for your son is disregarded for TC purposes and not counted as Income, so you benefit for this. Thirdly HMRC and customs have to make a decision whether you are Living Together As Husband and Wife, this is about te organistaion of the household - where you see your future, who pays the bills etc and if you are both in the family home you may have difficulties with this. You should advise HMRC straight off of the situation.

If you are turned down seek advice either from your local Citzens Advice or the Welfare Rights Team at the local Social Service as you may be able to appeal the decision
