She never signed any INS forms, the marriage never even got beyond the ceremony, because the groom disappeared & had no contact with the broken hearted girl until he decided to contact her apx 6 months later to tell her to sign his paperwork so he could stay in the US as a student & keep his job! She never even saw her marriage license, but after I helped her to get a copy from the California County Courthouse, she then had his full name & address. She has no money for an annulment. What can she do to break free from this burden. His family is protecting his whereabouts & offered money to have the INS paperwork signed! She refused & wants nothing to do with this fraud of a man, yet she is legally married to him. What should she do? She is hiding from this man & his family of pressure freaks! It happened over 3 years ago & the INS will not help or give her a status report on his deportation status. Does she need a Lawyer? She just want to break free of this mess!

This is a VERY SERIOUS situation.

1. She needs to contact USCIS office (go to www.uscis.gov) and make an INFOPAS appointment. Go there and tell the whole situation.
He might forge her signature on I-130 form, or whatever he could do. So she needs get full info there. This is a marriage fraud, and theyshould take it seriously.

2. Go to police and make a restraining order. This is a bad situation. She is legally married to the man, for more then 2 years. if she dies, he is eligible to GC. Remember that. Explain pressure and stuff from his family. If they treatened her - they should be punished.

I hope these 2 things will have him deported (for marriage fraud) and banned for life. Hope family members be punished too.

EDITED TO ADD: She might be afraid that INS will prosecute her as a part of sham marriage. And her groom might tell her that to. Dont be afraid, she wont be held responsible. Its difficult to prove, and even in obvious cases where a woman married 20 pakistanis, she wasnt punished (though she should have been).
Do not take money from them.

My suggestion would be to contact the INS and let them know what is going on with the 'marriage' and with his family in general as it pertains to this attempted fraud. Any proof that gave been forwarded on to the INS will be used in court for attempted fraud and falsification of government documents - after which people will be jailed and deported/banned from entry within the United States again.

The INS actually may very well be able to help have the marriage annulled - or at the very least help point her towards someone that will help her do that.

There is a man in the small town near me that did similar - except his was a internet bride situation. Sadly, this is happening more often that ever hits the news.

Hope the sorry illegal that did this to your friend is totally punished to the fullest extent of the law - and they have learned a very major lesson from all of this and never do such again.

If a illegal married your daughter, and they did not live together as man and wife, sign contacts, and claim each other on taxes, then INS does not recognize this as a legal marriage, especially when one needs citizenship papers. Offering money to sign INS paperwork is illegal also. You need to make a report to INS of the fraud, he used the girl to get married, have not been living together, no contacts , no nothing , other than a marriage ceremony. INS should look in to this. If you have the name, address and other info, get a lawyer, tell him to do a divorce. I know he will not be able to find the illegal since he is probably shacked up with some female illegally here also.. The Lawyer can get her a divorce, tell him to use "notification by publication" he will know what this means. Have him to do this both in English and Spanish. She can get a divorce be free of the jerk.

I say absolutely talk to a lawyer and perhaps even immigration officials. If the paperwork hasn't been signed then I assume he isn't here legally. What a scumback. I hope they deport him back to wherever he came from and in the process his family too! Tell her to contact Bill O'Reilly or Sean Hannity. As champions for securing the border and fighting illegal immigration, I bet she could get some help that didn't cost her.

....You don't need him to get a divorce, since an annulment would be just impossible since is over 3 years. There are some lawyers who would get "her" divorced without him even being present, as long as there aren't children involved. My advice...next time take more time to get to know a person before jumping into marriage, no matter what country they are from!

She should work hard and save money to get a lawyer. I guess that he is here illegaly if the marriage happened 3 years ago.

Tell her to tell him to get the heck out of here. He's Indonesian? He's probably a muslim and they're heavily anti-American in Indonesia even though we gave billions of dollars of aid to their 3rd world sh**hole after the Tsunami. She should seriously follow type2negative's advice and contact USCIS immediately and law enforcement.

If that were one of my sisters, I would beat the living day lights out of that Indonesian monkey and break his knees with my martial arts stick or baseball bat.

Have her get an attorney and get the marriage annulled. Borrow the money from friends and relative so she can get this done now.
