My old job is like screwing with me about my W-2. Now if for some reason I can't get my papers from them or from Labor people or IRS will I go to jail?

I'm only going to be recieving like $160 or so.(not much what so ever)

How does it work if I don't file it?

Ok, I'm NOT getting an answer to the JAIL question, so thats why I keep asking.

No you will not go to jail, but you could lose out on your refund.
You need to file to get your refund, and to also build a history with the IRS, there maybe a day when You want to apply for a loan for a car or a home and they would want a copy of past tax returns. If you don't file, there won't be any proof that the banks require.

by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

It would be extremely unlikely that you'd be sent to jail over not claiming $160. What would probably happen is that the IRS would send you a letter telling you you hadn't reported that on your tax return. If you owe additional taxes because of it, they'd send you a bill for the amount, and if you didn't pay it, would take it out of your next refund plus interest and penalties.

How many times are you going to ask this question? The answer hasn't changed in the last half hour.

If they haven't sent it to you by 2/15, call the IRS and they will help you. Your return isn't due for more than 2 months, plenty of time to get things sorted out.

If you have a refund due, there is no penalty for not filing.

you must file your taxes. Do not listen to anyone who tells you different. They won't be going to jail.

The IRS can make your life a living hell; or ignore you completely. All you have to do is file a tax return. It takes a few minutes and it is over.

Get on with it and get on with life.

The government doesn't want to put you in jail. It costs too much money.

If you don't file on time, they will start charging you interest on what you owe them until the time that they receive and process your return.

If you are not receiving the paperwork, go to your local IRS office and discuss it with them. It sounds like the employer doesn't want to file his side of the documents with the government so it's his fault.

You have to file. If you call and request of copy of your W2 and document that you did it and they still don't send you one you have one option. You must then call the IRS and inform them that they did not send them to you. Then the IRS will get involved, and your employer is NOT going to like that. But to answer your question, YES, you still have to file by April 16th.
