Unknown with the information you have given. What are your losses? How much damage to your car? What year, make and model? Any missed work or medical bills? What advice is your insurance company giving you? Just because he owns an oil company doesn't mean you just hit the lottery.

The relevant questions:
1) Was there a police report?
2) Do you have medpay on your policy (if so, that gets used first)?
3) What kind of medical expenses / missed work are we talking for you (insurance seeks to make up for losses/damage even-steven, not "hit lotto")
4) Are you going through insurance, or are you just suing the guy (pain and suffering, e.g.)? Is there anything to prove that this was the guy?
5) For a back injury, you may need to prove that your injury was as a result of the accident, not a pre-existing condition. If it was pre-existing, showing that this aggravated it may get you where you want to go. (Note: I'm not a lawyer or doctor)

What the other driver owns or does not own is irrelevant. You should be dealing with his/her insurance company. As far as a settlement, were you off work for a day, a week, months or are you permanently disabled? Those are more relevant questions than who the person was and what their status in the business world is.

What's the difference-oil company or 7/11 franchise? Sounds like you're trying to make big $ on the deal. If the guy hit you and ran, he's getting in trouble with the law and his insurance should pay all your losses.
