What happens if even I threaten them with the labor people and still nothing? What do I do?

Call them back and tell them you haven't received them yet and request a duplicate copy. If you still don't have them by 2/15, call the IRS and file a missing W2 complaint. They will investigate the issue and either secure the W2 for you or assist you in providing alternate documentation.

You still must file your return by April 17, 2007, no matter what. But there's still plenty of time to get it resolved; it's way to early to worry about it yet.

There's no need to threaten anyone. Just ask for a copy! It's not hard! Employers do this all the time!

(And going to the state labor board would be a waste of time; they can't help you. That was a joke of a recommendation.)

Whether or not you'll be in trouble for not filing depends. If you have a refund coming, you won't get it. If you owe any tax with the return, you'll pay penalties for late filing and interest for late payment of the tax.

Call them again and tell them you never got it. Verify the address they have for you, and ask them to send you another copy.

If you still don't get it in a week or two after that, call the IRS.

You can't just not file - yes, you'd be in trouble. Not jail-type trouble, but it would end up costing you extra money - no point in doing that! The IRS would eventually notify you that you had not filed on some income, and would tell you how much extra you owe them if you owed them extra because of this missing W-2.

Request a duplicate and if you still don't get a W-2 file using your last pay stub(s). It should have all deductions listed and enclose a note that your employer never supplied you with it. THEY will be in trouble, not you. I had to do this some yrs. ago with a jackass I worked for.

Don't threaten them, just ask for another copy. And make sure they have your correct address.
Yes, you will be in trouble if you don't file.

I just talked with the company that does the taxes for my former employer.

They're emailing me my w2's as we 'speak'.

See if you can find the dept/person who does them and see if they'll help.

Good luck!

Contact them and ask them why and to send it to you. If they give you any grief then tell them the Department of Labor (for your state) will be contacting them shortly. I would estimate that you will have your forms within 7 days.

The IRS says you "should" receive your record by January 31. If you don't , call your employer. If you dont get it by the end of February, the IRS says to report it to them. (IRS).
