my ex-girlfriend left some of her property in our old apartment (clothes, pictures, digital camera, knick-knacks, etc.) Our lease expired January 31st and my dad is having to pay an extra months rent so we can clean the apartment out. I went there a couple of days ago and took some of the clothes and electronics. She calls my dad yesterday and tells him that she's going to the apartment (today) to get the rest of her stuff. Since she was told to have everything out of there by the 31st of last month should I give her her things back? Or just tell her tough luck, since she wasn't out of there on time? By the way we broke up 10 months ago because I decided to get clean and sober and she wasn't ready to.

she knew she had to be out of there by the 31st and i think she is taking advantage of my dad's kindness. i haven't lived there in 10 months and the lease is in my name.

yes - it was a same sex relationship - thats not the point thought. the question i am asking is does she have any rights to her property since the lease expired and she left it there and all of a sudden wants it back?

I would give her stuff back to her. it may have some sentimentary value to her.. besides it was hers to begin with.. but I would ask for some storage pay ...its the least she could do for your trouble of having to store it for her..maybe a dollar a day or 5 dollars per week that you stored it would be appropriate.. as for the same sex thing.. to each his/her own

Yes you should give her the rest of her things back as well as hand her a bill for the amount of time her things were kept stored at the apartment...what you SHOULD have done was gone to a storage place and put her things in there, and then given HER the information from the storage place and told her that if she wanted her things back SHE would have to pay the storage fees. If she doesn't pay your father back your only recourse would be to take her to small claims court....
BTW if she moved out 10 months ago and left her things without paying storage on them you actually had NO obligation to keep them...

legally you have to hold private property for a month w/h paid rent.... after that you can do what ever you want....

I would get the extra month's rent out of her.
If she doesn't cough it up, keep her stuff.
