my fiance has a daughter from a previous one night stand and up until recently he has paid child support but the woman who has this child wont let the child come and see him ever. (we live in another province) my fiance is fed up and has stopped sending child support.(he has since opened a bank account to put child support into for his daughter when she is older) they have never gone to court he just pays and she wont take him to court does
this raise a red flag to you? i am thinking it is DNA testing time agree or disagree?

he has never been to court she wont take him to court and when he paid child support she wasnt grateful..also she has 4 other kids whom she doesnt collect child support for.

he has had a relationship with his daughter in the past she is a beautiful little girl but since we moved to another province he hasnt been allowed to see her

If he has been paying child support he should get visitation rights. He can go to family court for a small filing fee and get these rights, which will be ensured by court order. He can withhold child support, because it seems he is not forced to pay by any court but has so far done it voluntarily. Plus, he can have the court order for visitation enforced. It would be supervised visitation, but it would be better than none at all.

There is something very fishy about this. He needs to take her to court. I commend him on paying in the 1st place. But not being able to see the child, no way. It is not right at all. I think it is time for DNA testing and some court approved visits. She could be doing this to many others. How awful. I wish luck with this and hope that things work out.

He should most definately take her to court and get the DNA test! If it comes back his child then he should have the courts set up child support and visitation. If it comes back not his then he should sue her for all of the money he's already given her in child support!

He should go to court and get an order for a paternity test ASAP. If the child is his, he has rights to see the child and the court will also rule on visitation. Has he ever seen the child?? How can he be sure that there is a child if he has never seen it?

Sounds like it's time to call a lawyer. As long as your fiance is a"fit parent" then there is no reason why he wouldn't be awarded visitation... especially if he has been paying child support.
Maybe requesting a DNA test will scare the Mother into being more lenient.

Well, obviously he feels there is a good chance he is the child's father, but I would agree that a DNA test would be appropriate, especially if he would like to have visitation rights. Hope he hasn't just been duped out of money all this time.

paternity should have been established when the child was first born.
same thing happened to my husband, she filed for support when the child was 9, he never responded, like an idiot, and he was named father by default, finally when she was 16 he got a paternity, always believing that he was not the father. wrong, he was. mother would never allowed him pictures or contact. we pay child support, but there has never been any contact with her.
the whole situation is as dysfunctional has you can get.
the mother was more intrested in trapping him, then the welfare of her child. she told him she was on the pill, and then hid the fact she was pregnant for 3 months. that was her trump card when they broke up.
my opinion, all children should know who their parents are, all children should be born to two loving, caring, committed people, and not be used as tools for dysfunctional parents.

Most definitely DNA time. I can't understand how a government can force one to pay child support but not allow one to see the child. That just baffles me.

This guy should have had a DNA test done to determine paternity long ago, before he even started child support payments. No one expects him to support a child which is NOT his.
