In some cases if the women has the right she can do the same other wise she has to file for a divorce in court in front of a judge that can rule either way

Of all the things held permissible to a human by Allah, the most displeasing is Divorce (Talaq).

Allah has given specific instructions of divorce should such a task have to take place.

Divorce can never be offered at once (There is misconception even among Muslims that The Triple Divorce System is valid. This means that Three Talaq's which finalise the divorce can be given declared at once. This is incorrect).

If Divorce is to be seeked by either of the couple, the first Divorce is initiated by that person. After that, a period of a few months is alloted as time for reconciliation. This is to provide time to rethink their decision. Should they want to negotiate and Reconcile after the period then the Talaq can be undone. Otherwise they might chose to take more time or declare the second Talaq. Similarly, time is given once again.

If Divorce is accepted as the only possible solution, then the final Divorce is declared and the wife is given proper advantages or facilities to allow her independance.

I do not know the details but have told all that I know.

The most peaceful method ( in regard by the previous answers u got ) :

shariah questions- bro i didnt even know what it really was when i started uni 2 years ago. This is complex- the people here are not islamic judges lol

there are islamic court divorces

muslims and non muslims fail to understand that shariah is largely a methodology to law rather than point blank law (black letter)

By saying you divorce your wife three times. You can also write your wife 3 letters and state you are divorcing her....you can get a lawyer to write a letter for you or a woman can apply for divorce if she wishes too-but can't do the three times rule.

Muslims firmly believe and strictly practise the teachings/commands of their holy book Quran & their Prophet, which is their Code of Life at all times/places. They have the written, clear and unambiguous teachigs.

There is absolutely no concept of divorce or separation in Hinduism and Christianity. Their marriages are eternal, ever lasting and totally unbreakable, despite divorce decrees/judgements under any man made legislation and law of Govt. Under such Govt. laws, the couple has to allege divorce reasons and prove them by evidence before open courts in view of public.

Muslim couples need not appear before any authority or court for divorce to clean their dirty linen publicly, which defames spouses and their families and makes subsequent marriage more difficult. In Islam, there is provision for divorce under certain circumstances with certain conditions. If dispute arises among spouses, one arbitrator from each side will hear and settle. If failed, and husband wants to divorce, he may pronounce one talaq divorce (while wife is not menstuating) and keep the wife in his house. If spouses do not change themselves witin a month, husband may pronounce second talaq divorce in the next month, while she was in his house. If no change, husband may pronounce the third talaq divorce in the third month while wife remained in his house, which finally ends the wedlock. It takes 3 menstruating cycles (3 months) to complete the talaq divorce process, while wife remains in husband's house. During these 3 months if spouses has a single intercourse or wilful bodily touch or husband recalls talaq divorce even orally, the divorce process will abort and the wedlock continues as normal. Usually spouses change themselves during these 3 months and forget the idea of talaq divorce. Even after final talaq divorce, wife has to remain unmarried for 3 more months to verify pregnancy and shall be maintained by former husband. She marry any other man after these 3 months or after pregnancy comes to end. If wife demands divorce, husband may pronounce talaq divorce or may not. If valid reasonable grounds exist as per Islamic teachings for separation, the wife may approach any judge (Quazee) and seek separation. In secular countries, the courts will do it and in India under Muslim Marriages Dissolution Act 1939. In Islam, divorce is considered as the worst among permitted ones. However under unavoidable circumstances, it becomes a must. Islam totaly prohibits/bans extramarital sexual relations as a grave sin punishable continuously in hell and with death by pelting stones publicly. If one is interested in sexual relations with somebody, it should be under the wedlock only and never extramaritally or casually.
