If she is going to trial and is found guilty she can expect most likely a higher sentence. This deal the court is offering her is on the table now. IF she refuses the deal, she is now back to square one. WHICH MEANS the court can give her the maximum sentence. So the 16 months they are offering her most likely went up.

If they have it on tape, she really doesn't have a defense. Plus, they'll have all the results of her BAC test. What would she say at trial?
This case sounds pretty solid. A judge or jury won't lower her sentence and they'll definitely not say she's innocent.
It sucks, but she should take the deal. Otherwise, she's risking getting the max sentence.

She should be responsible and mature and accept her punishment, and while she's behind bars, she can spend some concentrated time learning about how DUIs cause the many deaths of innocent people - like a drunk did to somebody in my family.

She should take the plea and get some help. Drinking and driving is no laughing matter. I was hit by a drunk driver 13 yrs ago and am still suffering because of it. I have ZERO sympathy for people who do that.

It is her choice and I hope which ever one she decides, she spends her time incarcerated thinking about how lucky she is she didn't kill someone.
