when i found out my employer wasnt taking out city tax ( i live in brooklyn nyc) and he hadnt told me that the payroll was set up without taking it out. Should he have notified me? Or was it my fault for not saying anything to begin with. Now I have ended up with a lump sum tax bill instead of it being taken out each pay period.

Did you look at the pay statements you should have been receiving every payday? You should have noticed that city taxes were not being withheld. Even if you employer is at fault, and I think they are, YOU are legally responsible to make sure your taxes are paid. In any case, retroactive withholding is not possible.

Check it out ask him if next year he can take out city taxes if not find another employer or start saving on your own. I'm sure a number of your colleges have had similar problems. Good thing you have a couple of months to file. Oh and by the way it is legal for you to wait three years before filing this years return.

Too late now. If you get a penalty from city then employer needs to cover. Otherwise be happy he did not withold & you had use of the $$.

It would have been nice if they had notified you, but it's basically your responsibility, so both taxes and any penalties are yours.
