My sister told my mother that a credit card company took her tax refund from her checking account where it had been direct depostied for an unpaid bill. Causing her account to be overdrawn. Can they do that or is she just trying to get money from my mom? She said she didnt give them permission they just took it.

Sounds phony to me. They would need to have won a lawsuit against her, and even they, the CC company wouldn't be able to touch a checking account.

If they did take an amount that had actually been deposited, they did not cause the account to be overdrawn. How would the credit card company even know the tax return had been deposited or what the amount was? The IRS certainly didn't tell them. Even if it were legal for the IRS to release that information, they are way to busy this time of year. Someone in this case is lying to someone. If the credit card company did make an unauthorized withdraw, the bank can give you a dispute form. Any fees caused by the unauthorized withdraw will be waived.
I disputed an unauthorized withdraw from my account Tue, Feb 6. My account was credited today, Feb 9.
