Due to IRS Privacy laws, nobody can or will tell you who claimed a dependent you should have claimed. And if you file electronically, the second claimee will be rejected.

You must file by paper. Then the IRS will start an inquiry in which each person claiming the child must PROVE their right to claim the child. The IRS has final decision authority. If someone got a refund they were not entitled to, they'll have to pay it back with interest.

And no, the wrongful claimant will NOT go to jail. But a big tax bill will be the reward.

Fun!

That is a good question. The exact samething happened to my sisters boyfriend. He has papers from the courts saying he can claim his son. When he went to file taxes H&R Block said someone already claimed him and when he showed them the court paper H&R Block said to bad that paper doesnt mean anything. And they wouldnt tell him who claimed his son. He talked to someone from the IRS and they said the samething. I hope you have better luck then he did.

Mail your tax return, claiming him if you are eligible. The IRS will send both you and the other person letters asking you to prove that you are the one eligible. Then the person who isn't will have to pay back whatever they got for him, plus interest and possible penalties.

You need to find out who is claiming your son and why. If it is his father, come to some agreement about the dependant situation, if it's some else, tell the IRS.

well, if your child looks like a horse and has tax papers attached to his/her mane, that might be a dead giveaway.
