I live in Florida, and one of my friends has 2 children, ages 1 and 3. She noticed that one of the workers were smoking on the premises. Is there any law against this? If so, can you provide any proof of it?

Well, I live in Calif, and it IS against the law for a person to smoke on the premises of a child care center or any place where children frequent (including parks). My advice is to have your friend talk to the director of the center. Have her tell the director what she saw, and that she was concerned about it. She can even ask to see a copy of Title 22 (which governs childcare centers) to find out what it says. [By the way, it says that smoking on the premises is prohibited, which is superceded by the federal government's Health and Safety Code Section 1596.795 (b).] So, yes, there is a law against it- your friend should complain and see to it that the director of the facility takes care of it. No staff should be smoking on the premises of the center. It does not matter that the person was smoking outside... as long as it was on the grounds of the center (including the parking lot for parent drop-off) they are in violation of the Health & Safety Code.

If it was inside then I think there should be a law. But if the woman was outside, then what can you really do. I agree that caregivers should be good role models and not smoke, but after all it is america and people have rights to destroy their lungs and the lungs of others. Dont seem quite right but that is the price of a free society. Take the good with the bad.

I would talk to the head provider, and ask if there is a solution such as the smoker walking across the street or behind a building so the children dont see her smoking. At the very least.

Bring your concerns to the administrator of the child care center. They will be able to tell you where the appropriate smoking areas are for staff and others and they will also be able to deal with the problem directly.

i live in uk an i now laws r differnet but over here its common curtisy to smoke away from ur place of work ect an deffinitly not near a nursery ect. i work in a nursery an if a colluge of mine smoked near the buliding id freak 1 4 bein a none smoker myself an 2 the smoke may get to a child thorugh a window or a child cumin out of the building ect

definite, i think it. yet who's to blame for all of that ? that is not any longer the criminal illegals that are right here. we've regulations against being interior america illegally and the hiring of unlawful via our companies. yet our government of the two events do no longer do no longer something to offer up it. It really depends where she was smoking, if she was smoking outside and the children were inside that would be acceptable. If she is smoking with the children around, even outside, that would not be acceptable.

I would call the health department, it sounds wrong. Was she smoking outside on her break or in front of the kids
