One of you is committing freud. You likely know which of you it is. I would try to amend the frauduent tax return before the IRS tags it.

Oops, that's not going to work! Did he include your income on the "joint" return? Did you sign it? If everything was included, then if you're OK with it, you could just let the joint return go.

If he had already done this, and then you e-filed, your return should have been rejected, which is just like it was never filed. If you want the return filing separate to be in effect, then mail it in. The IRS will investigate why there are two returns for you, and if you didn't sign the joint one, will disallow that and he'll be paying some money back and probably penalties. If you are married and living together, you might want to think twice before you do that. If you're separated and he was just trying to grab your refund, then you could talk to him first and see if he'll turn the money over to you, or if that's not realistic, just go ahead and file your own return and let him explain to the IRS why he signed for you, which he isn't legally allowed to do unless you've given him power of attorney in writing.

What the heck??? You cannot be serious! A married couple cannot file jointly and then turn around and have a spouse file separately! This is a joke, right? I sure hope so or you are in big trouble with the IRS!

You either file separately or jointly, you can't file both ways. Something is definitely wrong with this picture. Be prepared for a visit from the IRS.

How is that possible? If he filed jointly, your ss# would come up and kick your return out. Maybe that's why you didn't get your money back yet. Expect a letter from the IRS...and soon.

how did he file jointly without your signature? He needs to amend his return since you didn't sign anything - that sounds like fraud
