My employer has still not mailed my 1099 form to me. How do I file to make sure that he is assessed a penalty?

First, make sure that he is required to. If he paid you less than $600 he is not required to by law. Second, call him to make sure he mailed it to the right address. Lastly, it might be in the mail, give it a little bit more time. Otherwise, call the IRS.

You can file a complaint with the IRS beginning on 2/15. That will get action on your W2.

It will be entirely up to the IRS whether or not a penalty is assessed. You have no say in that, it's strictly between the employer and the IRS. (And you have no right to know if a penalty is assesed, any more than I have a right to know about YOUR dealings with the IRS.)
