We married in december 2005 but didn't get our marriage license. We didn't file income tax jointly and we put single on our w-4s. Were we able to do that? Do we have to put married on our w-4s and file income tax jointly? We don't still have our marriage license but plan on getting it.

You can put anything on your W4, it does not affect your filing status. The W4 only tells your employer how much tax to withhold, that's all.

If you are married, you should normally file a joint return as you will pay much lower tax. The only alternative is to file married filing separately; you CANNOT file as single if you are married.

However, if you did not get a marriage license, you are NOT married unless you live in a state that recognizes Common Law marriage AND you meet the state's requirements to be Common Law husband & wife.

You don't need a " Marriage License " to file your income taxes. Its better to file: Married filing separately as for now if you choose to do so. Then when you're owning a property such as real estate then its best to file as: Married Filing Jointly cause penalty for Marriage tax has changed 4 yrs ago, its only benefit both of you.

It doesn't matter whether you have your marriage license in hand as long as you are married. The W-4 is simply a way of telling your employer(s) how much money to withhold and many married still claim single on them, but I advise against it for reasons that are too long to post here. As for filing your taxes, you must file either MArried Joint, or Married Filing Seperate. Check your taxes out both ways and go with whichever of those two options gives you the best net refund. claiming single on your W-4's you should be getting a refund.
