I contacted my previous employer, they said I couldn't get another until the one they mailed comes back to them.

That is NOT correct! It is possible that the original one was destroyed in the mail or was mis-delivered to someone who failed to put it back in to the mails.

Employers cannot put conditions on re-issue of Form W2, although they are allowed to chage a reasonable fee.

If they have not replaced it by 2/15, contact the IRS. The IRS will contact the employer and find out why you did not get your W2 and will secure a replacement.

Do NOT use the Form 4852 unless you have contacted the IRS first and they have advised you to use it. The "tax pro" is giving you bad advice.

That sounds correct.
Some forms provided as electronic files on IRS.gov are for "information only" and should not be reproduced on personal computer printers and filed with the IRS. The printed, paper version of these forms are developed as "machine readable" products. As such, they must be produced using special paper, special inks, and within precise specifications.

The list below identifies these "information only" forms. Additionally, a cover page is included with the downloadable file that may have more specific information concerning the individual product including possible fines for improper use.

Form W-2 (series)
Form W-3 (series)
Form 941-M
Form 1096
Form 1098 (series)
Form 1099 (series)
Form 5498 (series)
Form 5500 (series)

The printed version of these forms may be obtained by calling 1-800-TAX-FORM (1-800-829-3676) or by ordering online at forms and publications by U.S. mail or employer forms and instructions.
Call that number or scour that site.

As of 2/15 you can call the IRS and report it, that's just next week. The IRS will convince the company they can't "refuse".

Go to IRS.GOV and download a copy of Form 4852 Substitute for Form W-2. You can fill it in yourself. No need to wait on your Employer.

They are being a pain, making another copy is not illegal. Look for your last pay stub, it might have the info you need. Otherwise keep bugging them on a weekly basis until you get it, pick it up if necessary.
