You could be arrested for intent. It is not likely, but if intent is proven the officer has a duty to prevent the criminal intent. Kinda gray area of law there, fact is they are hired to serve and protect. The policeman would be remiss in duties if they did not take some action to prevent a law being broken.
Then again, it is in the officers best interest if they tell you go for it, then radio a car, stop you, take your car and sell it. Confiscation laws bite hard and are incentive to allow the crime to take place so that a 'proper' arrest can be made.
They might tell you it is a bad idea, most humans would, but by some state laws the officer could make an arrest. Even if it is not an arrest, they can hold a person for 24 hrs without a charge.
Bring a lunch.

Well the person asking has committed no crime. The police officer would probably just warn him of the dangers and consequences

technically nothing would happen. I would hope the officer would talk to you about the dangers of drinking and driving and also probably tell you they will be watching for you

Cool I've seen this happen back in Texas ! They will wait and tell you to go away if you were already drinking let you put your key in the ignition then just walk up to you and arrest you for D.U.I ..

they would say don't do it. the cops cant do anything if you are just thinking about, only if you attempted it or actually do it. but they can keep a close eye on you if they think your about to do it. seriously, do you have any idea how many people would be in jail if thinking about committing a crime was a crime? if stating you were thinking about it was a crime?
