like do you think the uncle and his wife could try and get custody of the child

Unfortunatly age has a lot to do with grand parents getting custody of a young child.... But, a lawyer could give you better advice than anyone on here..... I suggest that IF grands want the child that they seek legal help ASAP !!! God bless

I think it depends on the situation. If the mother should truly not have custody & the grandmother or uncle or any family member for that matter, can provide a good loving home for the child, then I think they should try for custody. But the family member that gains custody, must treat the child fairly and also understand that the child may miss the parents they were taken away from..no matter what occurred in the home for the parent to lose custody. The new guardians must be understanding. GOOD LUCK

If the uncle and his wife feel they are most fit then it is best for the child. A determination of the court would have to find the grandmother unfit. If they request a custody hearing they can ask for them to be considered for the best intrest of the child. Legal fees usually are a factor unless your court will grant court appointed council. Good Luck! Proving what is in the childs best intrest could be difficult.

Many grandparents today are raising their grandkids. As a former social worker I can tell you that the state would rather place kids with relatives than in foster homes. THe kids just do better that way. Contact your grandchild's social worker and talk to her about it. Probably you will have to have a home study done where a licensing social worker will come out and ask you questions and get references and look around your house. This is not a big deal but it makes people nervous, I know.

you elect a legal expert, yet you do have a stable case, particularly in the experience that your grandmother has lost 2 infants this 3 hundred and sixty 5 days. that is not any longer incorrect of you to get custody, yet i will see why the grandmother and aunt are indignant.

I think you should give it a try. I am sure the state would rather see the child with some of the family. I would certainly give it a try if it was my nephew. I sure wouldn't want my family members awarded to the state. Have you discussed this with any of your family members? You should probably contact DHS and let them know you are willing to take the child and take care of him.

i think you all need to think about what is right for this child and who is going to be able to provide a safe and loving home. Too many people are selfish when this situation arises and they tend to overlook what is best for the child. Good luck and i hope you can provide this child with what he needs.
