Depending on the circumstances, if you are found to be negligent, then you could be charged with Vehicular Homicide or Vehicular Manslaughter.
Say for instance you were text messaging or putting on your makeup and hit someone, you would likely be charged.
If the wreck was "unavoidable" or a "no-fault" then likely you won't have to worry about being charged, although you never know when someone will bring a civil suit against you and your insurance company.

Well, obviously, its a horrible situation for everyone involved..
but if you were at fault for the accident... your insurance will pay out for the deceased drivers vehicle repairs.. and also likely pay the deceased drivers family members under your bodily injury portion of insurance.
Beyond that- you may face charges through the police such as manslaughter.
Unfortunately- things like this happen but if you take proper precautions by having insurance.. you can make an unfortunate event like this be slightly less painful

Things happen for a reason. Im sorry about your loss, there is a thought that we are here to do a certain thing or things in this life, and when we have done them it could be time to move on to the next life, next challenge. It could be your brother has done in this life what he needed to and had to go to another life to do something else he couldnt do now. Accidents are there to start big changes, that event will shape your life. Try to make whatever positivity you can out of it.

Your insurance company will do everything they can to settle the claim within your policy limits, but sometimes they can't...especially if you only carry state minimum. You may choose to contribute out of pocket for what the insurance won't pay, or you will have to hire an attorney at that point. If you are sued your insurance company will get the lawyers to aid in your defense, but they will not do anything to protect your property/assets etc....the insurance company is only responsible to pay UP TO your policy limits, not a penny more.
If you are NOT at fault and sued, your insurance carrier will mount a defense. They will spend quite a bit of time on the phone with you discussing the claim investigating every little detail. Sometimes, they will still pay out on your policy if it's in your best interests but not charge you as "at fault."

Well they call them accidents for a reason.Give yourself a certain amount of time to feel bad about the situation just because it seems like the right thing to do.Say a month.Then after that just put it behind you and don't look back,life is life and theese things happen.Talk about it as much as possible for that month to get it out,YOU NEED TO GET IT OUT.Then go on living and do your best to be a good person.Don't let yourself get depressed about it ever again.If you start thinking about it then find something to do but as has been my experience after I set a month to be depressed I justify not feeling guilty ever again.Good luck and drive on.

Accidental car accident? There would be a police investigation, obviously, then it would move onto the DA to see if he thinks there was any criminal negligence.

They are definitley accidents for a reason, but often there are wrongful death lawsuits filed, depending on whose fault the accident was.
