If its only one extra carton, then they would just confiscate it. But if you go with a ridiculous amount extra, then you would be in trouble.

Last year i popped an extra carton of cigs in my suit case along with the others, guess what? i was stopped and the case was put throught the scanner.
I told the guy i wasn't very sure what i could take through, he must have believed my innoccence coz he let me go through BUT he did tell me not to do it again.
PS. On my very 1st holiday, many moons ago i went through the corridor marked " Declare" and paid the duty on an extra 200 cigs and a bottle of booze. What a numpty.

If it's your first offence, the worst they'll do is give you a warning and confiscate all the cartons. If it's just an extra carton and you're in doubt, go through the red channel - Customs aren't going to bother with the paperwork just to collect duty for one carton if you own up to it.

If from inside the EU... there is leeway. C&E site last time I checked said limit was there.. but its not written in stone law. So long as customs are satisfied its for your own personal use.
But the limit inside the EU for bringing cigs back is quite generous... 3000 isn't it ?
From outside EU you can't bring as many cigs back... 400 i think... and if you get caught with extra from coming back from outside the EU they may charge you excess duty.

You will be offered the choice to either pay the full duty on them or have them confiscated. Customs officials are not really looking for small amounts carried by occassional travellers but large-scale operations (van and truck loads) from countries where the tax is significantly lower.

I was leaving Savannah with a bottle of Paula Deen's BBQ sauce from her restaurant in my carry on luggage and didn't even think about the crazy new liquids restrictions... they kept my BBQ Sauce. I'm sure someone just took it home and enjoyed it.
They'll take your cigs, if you aren't supposed to have them, you can bet on it.

You probably have to pay the duty, plus a fine. I don't know for sure, but I would guess that the fine would be several times what the duty would be.

Don't take my word for it but I thought all limits had been dropped. All you have to do is convince the customs that they are for your own use. EU only.
